Terms and Conditions

Last updated: October 8, 2026

These Terms and Conditions ("Terms") are an agreement between you and Elite Mind Project. They cover your use of the Elite Mind mobile app (iOS and Android), our website at elitemindproject.com, and the mental-training program delivered through them (together, the "Service").

By creating an account, making a purchase or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service. Our Privacy Policy explains how we handle your information and forms part of these Terms.

We've tried to write them in plain language. If anything is unclear, email us at payam@elitemindproject.com.

At a glance

  • Accounts are for parents. A parent or guardian aged 18 or over holds the account, and children listen with you.
  • Elite Mind is mental-skills training, not medical care. It isn't a substitute for a doctor, psychologist or other professional.
  • Programs are one-time purchases. There's no subscription. Payments, and refunds, go through Apple or Google.
  • The sessions are for your family's personal use. Please don't record, share or play them to teams or groups.
  • You can delete your account from inside the app at any time.

1. Who we are

The Service is operated by Elite Mind Project, 10583 Dunleer Dr, Los Angeles, CA 90064-4317, United States ("Elite Mind", "we", "us" or "our").

2. Accounts and eligibility

  • You must be 18 or over and a parent or legal guardian to create an account. Children must not create accounts or buy anything themselves.
  • You're responsible for your child's use of the Service. Elite Mind is designed for you to use alongside your child. If you let your child listen on their own, it's your decision, based on what's right for them.
  • Keep your account secure. Give accurate sign-up information, keep your password private, and tell us straight away if you think someone else has used your account. You're responsible for activity on your account.
  • Signing in with Apple or Google is also subject to their terms. If you lose access to that sign-in, you may lose access to your Elite Mind account.

3. The program

Elite Mind is a sport-specific mental-training program for young athletes. It's made up of short guided audio sessions organized into weeks, with guidance to help parents support each skill. After finishing the program, your athlete can go through the sessions again in a mastery cycle.

Some sessions may be available for free. The rest of each sport's program is unlocked by a purchase.

We're always improving Elite Mind, so we may update, add, reorder or replace sessions and features over time. Updates to a program you've bought are included at no extra cost. We won't remove a program you've paid for without telling you first (see section 12).

4. Health and safety

Elite Mind is not medical or psychological advice, diagnosis or treatment. The sessions are general mental-skills and wellness training for young athletes. They aren't a substitute for care from a doctor, psychologist, counsellor or other qualified professional, and they aren't designed to treat any condition.

  • If your child has, or you think they may have, a mental or physical health condition, talk to a qualified professional before using Elite Mind, and follow their advice.
  • Stop a session if your child becomes distressed or uncomfortable, and seek professional help if you're concerned about them.
  • If you think your child is in crisis or in danger, contact your local emergency services straight away.
  • Sessions use relaxation, breathing and visualization. Never listen while driving, cycling, swimming or doing anything else that needs full attention.

Every athlete is different. We don't promise any particular result in your child's sport, performance or wellbeing.

5. Purchases and pricing

  • One-time purchases. Each sport's program is a one-time purchase, and the Dual-Sport Bundle unlocks both sports. There's no subscription or recurring charge. A single-sport purchase unlocks only that sport.
  • Ongoing access. Once bought, a program stays unlocked for as long as we offer Elite Mind, subject to these Terms.
  • Payment through the app stores. Purchases are made through the Apple App Store or Google Play and processed by Apple or Google under their terms. They charge you, in your local currency, and handle any taxes. We never see your card or bank details.
  • Prices. The price shown in the app, set by your store, is the price you pay. We may change prices, and offer launch prices, discounts or promotions from time to time. A change only affects future purchases. A promotion applies only on the terms shown when it's offered, and doesn't entitle earlier buyers to a refund of the difference.
  • Restoring purchases. Your purchases are linked to your Elite Mind account and your store account. If you sign in on a new device, use Profile → Account → Restore purchases to unlock them again.

6. Cancellations and refunds

Because purchases are made through the App Store or Google Play, refund requests are handled by Apple or Google under their policies, not by us. We can't issue refunds ourselves.

If you're in the EU or UK, you may have a legal right to cancel a purchase of digital content within 14 days. Where the law allows, by completing a purchase you ask for access to start immediately, and you acknowledge that you lose that right of withdrawal once access begins. Your store's own cancellation terms may give you more.

Nothing in these Terms affects rights you have under consumer protection law, including rights if a program you've bought is faulty or not as described.

7. Your licence to use Elite Mind

Elite Mind, including the app, the website, the audio sessions, scripts, parent guides, artwork and our name and logo, belongs to us or our licensors and is protected by copyright, trademark and other laws.

We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service, and the programs you've bought, for your own family's non-commercial use, in line with these Terms and your app store's rules. You may not:

  • copy, record, download (other than as the app allows), share, sell, rent or publish any session or other content,
  • play sessions to a team, class, club or other group, or use them in paid coaching or training. If you'd like to use Elite Mind with a team or organization, please contact us,
  • get around purchases, access controls or other limits on the Service, or help anyone else to,
  • copy, modify, reverse engineer or decompile the app, except where the law allows this despite this restriction,
  • use our name, logo or content in a way that suggests we endorse you.

8. Acceptable use

When using the Service, you agree not to:

  • break the law or anyone else's rights,
  • access or try to access accounts, data or systems that aren't yours,
  • interfere with, overload or disrupt the Service or its security,
  • use bots, scrapers or other automated tools to access the Service or collect content from it,
  • upload or send anything harmful, such as viruses or malicious code.

9. Your information and feedback

The details you add to your account, such as your name and your child's first name, remain yours. We use them only to provide the Service, as explained in our Privacy Policy.

If you send us ideas, suggestions or feedback, you agree that we may use them to improve Elite Mind without paying you or owing you anything.

10. Notifications and emails

We send emails needed to run your account, such as confirming your email address and resetting your password. Push notification reminders are optional. You choose which ones you get in the app, and you can turn them off at any time there or in your device settings. If you join our waitlist, we'll email you about the launch, and you can ask to be removed at any time.

11. Third-party services

The Service relies on third parties, including Apple and Google for sign-in, app distribution and payments. Your use of their services is governed by their own terms and privacy policies, and we aren't responsible for them. The Service may also link to websites we don't control, and we aren't responsible for their content.

12. Availability and changes to the Service

  • You need an internet connection to sign in and play sessions, and your mobile operator's data charges may apply.
  • We may need you to install an app update to keep using the Service. Older devices and operating system versions may stop being supported over time.
  • We work hard to keep Elite Mind available, but we can't promise it will always be uninterrupted or error-free. We may pause it for maintenance or for reasons outside our control.
  • We may change, suspend or stop offering parts of the Service. If we plan to permanently stop offering a program you've bought, we'll give you reasonable notice in the app or by email first.

13. Deleting your account, and suspension

You can stop using Elite Mind at any time and delete your account in the app: Profile → Account → Delete account. Deleting your account permanently removes your account, your profile and your listening progress, and it can't be undone. It doesn't cancel or refund purchases, which stay linked to your Apple or Google account. You may be able to unlock them again on a new Elite Mind account with Restore purchases.

We may suspend or close your account if you seriously or repeatedly break these Terms, if we're required to by law, or to protect the Service or other users. Unless the law or security reasons prevent it, we'll tell you why and give you a chance to respond.

Parts of these Terms that by their nature should continue after your account is closed, such as our ownership of the content, the disclaimers, the limits on liability and how disputes are resolved, continue to apply.

14. Disclaimers

We provide the Service "as is" and "as available". To the fullest extent the law allows, we make no other promises about the Service, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement, and no promise that it will meet every need or produce a particular result.

Some places don't allow these disclaimers, so they may not all apply to you. They don't affect your rights under consumer protection law.

15. Limitation of liability

To the fullest extent the law allows:

  • we aren't liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Service,
  • our total liability to you for all claims relating to the Service is limited to the greater of the amount you paid for Elite Mind in the 12 months before the claim arose and US$50.

Nothing in these Terms excludes or limits liability that can't be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud. If you're a consumer in the EU or UK, we're responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill.

16. Indemnity

To the extent the law allows, you agree to cover our reasonable losses and costs, including reasonable legal fees, arising from a third-party claim caused by your breach of these Terms or misuse of the Service. This doesn't apply if you're a consumer somewhere the law doesn't permit it.

17. Apple App Store and Google Play

If you downloaded Elite Mind from the Apple App Store, the following also applies:

  • These Terms are between you and Elite Mind only, not Apple. We, not Apple, are solely responsible for the app and its content.
  • Your licence to use the app is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
  • We're solely responsible for providing maintenance and support for the app. Apple has no obligation to provide any.
  • If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are our responsibility, to the extent these Terms don't exclude them.
  • We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
  • You confirm that you're not located in a country subject to a US Government embargo, or designated by the US Government as a "terrorist supporting" country, and that you're not on any US Government list of prohibited or restricted parties.
  • You must comply with any third-party terms that apply when using the app, such as your mobile data provider's.
  • Questions, complaints or claims about the app can be sent to us at the contact details in section 1.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, have the right to enforce them against you.

If you downloaded Elite Mind from Google Play, your use of the app and purchases is also subject to the Google Play Terms of Service.

18. Disputes and governing law

If you have a problem with Elite Mind, please email payam@elitemindproject.com first. Most issues can be resolved quickly that way, and we'll try to sort it out within 30 days.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute that can't be resolved informally will be decided by the state or federal courts located in Los Angeles County, California, and you and we agree to their jurisdiction.

If you're a consumer in the EU, UK or another country with mandatory consumer protection laws, you keep the protection of those laws, and you can bring a claim in the courts where you live.

19. Changes to these Terms

We may update these Terms as Elite Mind changes or as the law requires. When we do, we'll change the "Last updated" date at the top. If a change is significant, we'll tell you in the app or by email before it takes effect. If you keep using the Service after a change takes effect, the updated Terms apply. If you don't agree with them, you can stop using the Service and delete your account. A change to these Terms will never take away access to a program you've already paid for.

20. General

  • Entire agreement. These Terms and our Privacy Policy are the whole agreement between you and us about the Service.
  • Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver. If we don't enforce a right straight away, we haven't given it up.
  • Transfer. You can't transfer your rights under these Terms to anyone else. We may transfer ours as part of a merger, acquisition or sale of assets, as long as your rights under these Terms aren't reduced.
  • Events outside our control. We aren't responsible for delays or failures caused by events beyond our reasonable control.
  • Language. These Terms are written in English. If we provide a translation, the English version applies where they differ, unless the law requires otherwise.
